Welcome to Applied Digital Services. By accessing or using our website and services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use our services.

1. Services Provided

Applied Digital Services provides website-related services including but not limited to:

  • Website design and development

  • Website maintenance and management

  • Hosting setup and support

  • Content updates

  • SEO optimization

  • Funnel building

  • Technical support

Service scope may vary by plan or custom agreement. Any additional services outside of your selected plan will require a separate agreement or fee.

2. Eligibility

To use our services, you must be at least 18 years old and capable of forming a binding contract. By using our services, you represent that you meet these requirements.

3. Payment Terms

  • Payment is due upfront on a recurring monthly basis unless otherwise stated.

  • All fees are non-refundable unless otherwise stated in writing.

  • Failure to make payment may result in service suspension or termination.

  • You are responsible for providing accurate billing information and keeping your payment method current.

4. Client Responsibilities

You agree to:

  • Provide timely access to necessary materials, logins, and content

  • Respond to communication within a reasonable time

  • Review and approve deliverables when requested

  • Not use our services for any illegal or unethical activity

Delays on your part may affect timelines or service delivery, and we are not responsible for delays caused by lack of cooperation.

5. Intellectual Property

You retain ownership of any content, logos, images, and assets you provide. We retain the right to use frameworks, code, or systems we create unless otherwise agreed.

Upon full payment, you will own the custom work created for you (excluding third-party assets or software).

6. Third-Party Tools & Services

We may integrate or recommend third-party tools (e.g., hosting, email marketing platforms, CRMs). We are not liable for issues caused by those third parties and your use of them is subject to their terms and policies.

7. Termination

You may cancel services with 14 days’ notice in writing. We reserve the right to terminate services if:

  • You violate these Terms

  • Non-payment occurs

  • There is ongoing unresponsiveness or misconduct

Upon termination, any unpaid fees are still due, and we may retain work until the account is settled.

8. Limitation of Liability

To the fullest extent permitted by law, Applied Digital Services is not liable for:

  • Indirect or consequential damages

  • Loss of revenue, data, or business opportunities

  • Technical issues beyond our control (e.g., hosting outages, plugin conflicts)

Our total liability will not exceed the total amount paid to us in the last 3 months of service.

9. Disclaimer

We do not guarantee specific business outcomes, traffic results, or rankings. While we aim to deliver excellent service, all websites and digital strategies carry risk.

10. Modifications to Terms

We may update these Terms from time to time. Continued use of our services after any changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of USA/Texas. Any disputes shall be handled in the appropriate courts of that jurisdiction.
